By creating an account or using Akomalu you accept these Terms. Clicking “Create account”, or continuing to use the service, is your electronic agreement and has the same effect as a signature.
Eligibility
You must be at least 18 years old and legally able to enter into a contract to use Akomalu.
What Akomalu is
Akomalu is a charting and market-analysis platform operated by Akomalu Ltd. In its current pre-registration phase, Akomalu provides analytical and charting features only and does not accept, transmit or execute orders or hold client money or securities. It displays Nigerian Exchange (NGX) market data and computes standard technical indicators and pattern detections from it. What you see depends only on the price data and the settings you choose — never on anything we know about you. We do not use information about your personal or financial circumstances to personalise our analytical outputs, build portfolios or make recommendations concerning securities. Akomalu does not provide personalised investment advice or recommendations. Users remain responsible for their own investment decisions.
Market data licensing
Akomalu is not yet operating on licensed market data. A market data licence from the Nigerian Exchange is being arranged, and the platform will not be publicly launched until it is in place.
What Akomalu is not
Akomalu Ltd is not currently registered as a broker, dealer, investment adviser or portfolio manager and, during its pre-registration phase, does not execute securities orders, hold client money or custody client assets. We are not connected to your broker.
Not investment advice
Nothing on Akomalu constitutes personalised investment advice, an investment recommendation or a solicitation to buy, sell or hold any security. We do not use your investment objectives, financial situation, needs or risk appetite to personalise the analytical outputs presented to you. Technical indicators and pattern detections are computed mechanically from price data and describe what the data shows — they do not predict what will happen and are not signals to act. Decisions you make are your own. Consider taking advice from a registered investment adviser before investing.
Market data
Market data is provided by third parties and may be delayed, incomplete or incorrect. We make no warranty as to its accuracy or timeliness and accept no liability for losses arising from reliance on it. Data may not be redistributed, resold, scraped or used to build a competing service. Access may be withdrawn where a data provider requires it.
User-published content
Posts in Community are written by users, not by Akomalu. We do not endorse, verify or adopt them, and they are ordered by objective measures such as recency and popularity rather than by any view of ours. Posting content that is unlawful, misleading, manipulative or intended to move a price is prohibited and may be reported. We may remove content or suspend accounts.
Your account
You are responsible for your credentials and for activity under your account. One person per account. Do not share access, automate access, or attempt to extract data in bulk.
Verification (KYC)
Identity verification is currently voluntary while Akomalu operates in its analysis-only phase. Before trading functionality is activated, users will be required to complete the applicable KYC and onboarding requirements. You confirm that information you submit for verification is accurate and yours. The Privacy Policy describes how verification data is protected.
Intellectual property
The Akomalu name, design, software, indicator implementations and content we author belong to Akomalu Ltd or its licensors. You may use the service for your own analysis; you may not copy, scrape, reproduce or redistribute the platform or its data except as these Terms allow.
Third-party services and links
Akomalu links to third-party sites, including news publishers, and displays content sourced from them. We are not responsible for third-party content or services.
Suspension and termination
We may suspend or terminate an account that breaches these Terms, abuses the service or its data, or where the law requires. Where practicable we will tell you why.
Availability
We aim to keep Akomalu available but do not guarantee uninterrupted service. Features may change or be withdrawn.
Liability
To the extent permitted by law, Akomalu Ltd is not liable for trading losses, lost profits, or indirect or consequential loss arising from use of the service or reliance on anything shown on it.
Indemnity
You will indemnify Akomalu Ltd against losses arising from your breach of these Terms or unlawful use of the service, except to the extent caused by our own breach or negligence.
Force majeure
We are not liable for failure or delay caused by events beyond our reasonable control, including market-infrastructure outages, power or telecommunications failure, or acts of government.
Changes to these Terms
We may update these Terms. The version and date appear at the top of this page, and material changes will be announced on the platform. Continued use after a change takes effect is acceptance of the updated Terms.
Electronic communications
We communicate with you electronically — on the platform and by email to your registered address. Those communications satisfy any requirement for written notice.
General
If part of these Terms is unenforceable, the rest still stands. A failure to enforce a term is not a waiver of it. These Terms are the entire agreement between you and Akomalu Ltd for the analysis service. Sections which by their nature survive termination — including Liability, Indemnity and Intellectual property — survive it.
Governing law
These terms are governed by the laws of the Federal Republic of Nigeria.
